Entrepreneur Visas Australia

A number of different visas are available for entrepreneurs and investors in Australian companies.

  • 1. Business Innovation and Investment (Provisional)
  • 2. Business Innovation and Investment (Residence)
  • 3. Business Talent (Migrant)
1. Business Innovation and Investment (Provisional)

This visa is for people who own or have recently owned and managed a business or have a track record as a successful investor.

BUSINESS INNOVATION AND INVESTMENT (PROVISIONAL)

In order to qualify for this category an applicant must meet the following criteria:

  • 1. be less than 55 years old,
  • 2. have owned and managed a business,
  • 3. be sponsored by a State or Territory government,
  • 4. attain a passmark of 65 points in a points test. Points can be awarded for age, qualifications, business or investment experience, net personal and business assets, turnover, English language ability, innovation and special state/territory endorsement.

In addition, the applicant must meet the requirements of one of the two streams within this category: the Business Innovation Stream and the Business Investment Stream.

Business Innovation Stream
  • --- Net assets of at least AUD 800,000 available for transfer to Australia within two years of the visa grant and you must also meet the following business criteria:
  • --- Turnover of at least AUD 500,000 in one of more of the applicant’s businesses in two of the last four years immediately before applying,
  • --- Business ownership requirements:
    • 1. 51% ownership of a business with turnover of less than AUD 400,000, or
    • 2. 30% ownership of a business with turnover of more than AUD 400,000, or
    • 3. 10% ownership of a publicly-listed company.

This visa allows for an application for permanent residence at a later stage.

Investor Stream

. The applicant must have held net assets of at least AUD 2.25 million for the two fiscal years immediately before applying.

.Meet one of the following criteria:

  • i. Direct involvement in at least one of the five fiscal years before applying in managing the applicant’s own eligible investments of at least AUD 1. 5 million, or
  • ii. Direct involvement for at least one of the five fiscal years before applying in managing a qualifying business in which the applicant has held at least a 10% interest.

2. Business Innovation and Investment (Residence)

This visa is the second stage of the Business Innovation ans Investment Stream. In order to qualify for this category the applicant must hold a a Business Innovation and Investment Visa (Provisonal) and have met the requirements. The applicant must also be sponsored by a State or Territory government.
Other requirements for the application are dependent on the particular stream in which it falls.

Business Innovation Stream

The following crtieria must be met in this stream:

* Applicant must have been continually involved in the management of a business in Australia in the two years immediately before applying and have achieved a turnover of at least AUD 300,000 in the main business or two main businesses in the year immediately before applying.

* Meet the following ownership citeria in the business or two main businesses that meet the turnover criteria:

  • 51 % of a business with turnover of less than AUD 400,00 per year, or
  • 30 % of a business with turnover of more than AUD 400,000 per year, or
  • 10 % of a publicly listed company.

* Meet two of the following requirements:

  • - Net value of assets in the main business (or two main businesses) of AUD 200,000 throughout the whole year immediately before applying,
  • - Net combined business and personal assets of AUD 600,000 throughout the whole year immediately before applying,
  • - Employment of at least two Australian citizens, permanent residents or resident New Zealand passport holders, who are not family members, throughout the year immediately before applying.

Investor Stream

If the applicant holds a visa under the Investor Stream she/he must have held a designated investment with an Australian state or territory for at least four years before applying and must also confirm her/his interest in continuing the investment or business activity in Australia.

3. Business Talent (Migrant)

In order to qualify for this category the applicant must be less than 55 years old (unless this requirement is waived), demonstrate vocational English and be nominated by a state or territory.
There are two streams in this subclass, the Significant Business History Stream and theVenture Capital Entrepreneur Stream.

Significant Business History Stream

Application requirements in the Significant Business History category:

  • --- The applicant must have held net assets of at least AUD 400, 000 in a qualifying business for at least 2 of the 4 fiscal years before applying,
  • --- Total net assets of at least AUD 1.5 million available for transfer to Australia within two years of applying,
  • --- Attained a turnover of AUD 3 million or more in one or more of the applicant’s businesses in at least 2 of the last 4 years.
  • --- Business ownership criteria:
    • *** 51% of a business with turnover of less than AUD 400,00, or
    • *** 30 % of a business with turnover of more than AUD 400,000, or
    • *** 10% of a publicly listed company
Venture Capital Entrepreneur Stream

The applicant must have received AUD 1,000,000 from an Australian capital venture firm for the start-up, product commercialisation or business development of a high value business proposal.
